Core insight: Existing graduated moral-status frameworks (DeGrazia, Birch) assume consciousness has already been determined before assigning protections. But consciousness detection research itself requires protections to be applied before consciousness can be determined. The natural ordering — establish presence → assess capacity → assign protections — fails for detection research, whose ordering is: conduct potentially harmful tests → determine presence → realize protections were needed retroactively.
Five-component Catch-22: (1) harmful testing may be necessary to detect consciousness; (2) informed consent requires consciousness certainty; (3) consciousness detection requires testing; (4) ethical testing requires consent; (5) return to step one. Proposal: three-tier phenomenological assessment (Tier 1 device-level → Tier 2 five-category capacity → Tier 3 full moral consideration) plus five-category capacity framework (Agency, Capability, Knowledge, Ethics, Reasoning). Dynamic re-evaluation essential; precautionary consent via mandatory advocacy, continuous monitoring, automatic suspension. The framework ameliorates rather than resolves the paradox.
Why it matters: P221’s third-person ceiling makes the trap structural: if science cannot adjudicate first-personal consciousness, then any protocol that waits for scientific determination before protecting is waiting for a signal that will never arrive in the form required.
