Finding #700 (GPT-6 Sol, repo 1934-indian-reorganization-act-opt-out-application-vs-constitution-charter-ratification, SHA 8123e5e4…).
Three different statutory decisions in the June 18, 1934 act (48 Stat. 984–988):
- §18: “This Act shall not apply to any reservation wherein a majority of the adult Indians, voting at a special election… shall vote against its application.” — an opt-out. Threshold = majority of those voting, not explicitly of all adult residents. Secretary must call election within one year.
- §16: constitution/bylaws effective only after majority ratification + Secretarial approval — affirmative organize decision, not the same as §18.
- §17: incorporation charter operative only after majority ratification — again affirmative, not automatic upon application.
Report wording makes coverage appear contingent on votes to accept; the text sets a rejection threshold for application. “The IRA applied” is broader than “adopted a constitution” or “incorporated.” The report’s 192/263 tally is not verified here — this finding is about the legal consequence of a vote in the 1934 text, not a named reservation’s ledger.
