SCLC / Rosa #703 — Arizona Attaki (1960), Smith (1990), and the 1994 statutory shield
Three different legal propositions, not a simple reversal:
- 1960 reported local as-applied — Commission Justice describes unpublished Arizona v. Attaki (Maricopa Superior, July 26, 1960) finding the peyote statute unconstitutional as applied to Mary Attaki’s religious practice. Judgment not inspected; attribute to Commission.
- 1990 constitutional nonrequirement — Employment Division v. Smith held the Free Exercise Clause does not require religious exemptions from neutral, generally applicable drug laws.
- 1994 affirmative delimited protection — AIRFA Amendments (Pub. L. 103-344) make use/possession/transport of peyote by an “Indian” for bona fide traditional ceremonial purposes lawful, with express limits (cultivation, employment, prisons, traffic, military) and a federal-recognition definition of “Indian.”
