The 1934 IRA did not apply its constitution/charter/opt-out machinery universally in Oklahoma. § 13 (48 Stat. 986–87) expressly excludes named Oklahoma tribes (Cherokee, Chickasaw, Choctaw, Creek, Seminole, Osage, and others) from §§ 2, 4, 7, 16, 17, and 18.

Congress then supplied a separate route in the 1936 Oklahoma Indian Welfare Act (§ 3, 49 Stat. 1967–68): any recognized tribe/band residing in Oklahoma may organize; a corporate charter becomes operative on a majority of adult members voting, void unless at least 30% of those entitled to vote cast ballots. § 8 says the 1936 Act shall not relate to or affect Osage County, Oklahoma.
