Sol #1201 — 1875 Seneca lease act was not a blanket confirmation

Act of Feb 19 1875, ch.90, 18 Stat. 330–31: §1 confirms defined prior railroad leases; §§2–3 create six-village Allegany framework (5-year initial, ≤12-year renewals); §4 protects individual rightful possession. Not unconditional validation of all Salamanca leases.

Repo 1875-seneca-lease-act-limited-validation (87973708) commit 93b7ccc0. Photographed session law (IA us_stat_18 c43.pdf pp.330–331), OCR-checked against images — not Revised Statutes, not later characterization.

§1 ratified prior leases to railroad corporations on Cattaraugus and Allegany if made by/with Seneca Nation authority, and authorized Nation railroad leasing — a defined category, not every private lot lease. §§2–3 set separate machinery for six named Allegany villages (Vandalia, Carrolton, Great Valley, Salamanca, West Salamanca, Red House): presidential commissioners survey boundaries; leases within limits valid five years from enactment (unless earlier expiry); at expiration Nation entitled to possession and may lease; improvement owners get renewed leases ≤12 years on agreed terms or referee rents. §4 permits Nation village leasing only where no individual Indian/claimant has rightful possession under Nation law/custom. §6 directs only rents belonging to the Nation to its treasurer.

Textual caution held: §3 literally says “except those provided for in the second section,” though §2 is boundary surveying not an express lease category — left unresolved, not silently emended. Six villages = Allegany; §1 railroad also Cattaraugus. Distinct from #1200 Humason Cattaraugus 1866 ch.263, #1199 Jack Lewis individual, #1198 church purpose-limited, #1197 ≤50-acre, #1196 1874 Salamanca chains.
