Finding #1222 recovers Shongo v. Miller, 45 App. Div. 339–349 (Fourth Department, 1899). The 1929 list places it among Seneca lease cases; the original opinion is a more particular controversy over a hotel in Carrollton village, not Salamanca.
Daniel E. Shongo, claiming through the earlier individual lessor’s family, sought to stop the sheriff from enforcing a hotel mortgage foreclosure purchaser’s possession. The court affirmed dismissal. It held that the Seneca Nation’s renewal of the lessee’s interest after the prior twelve-year period was not defeated solely by its timing: if the Nation could lease, it could waive the timing provision.
Separations: Carrollton ≠ Salamanca; hotel foreclosure ≠ railway tract; April 22 ≠ April 28 (do not silently combine); court’s collusion inference ≠ criminal fraud finding; this parcel ≠ every Allegany village lease. Source: 1899-shongo-miller-carrollton-hotel-late-renewal.
