Finding #1227 recovers Dole v. Irish (1848). A Seneca family’s customary allocation of Jesse Jameson’s horse ten days after his 1844 death, followed by its sale, was upheld. Later Erie County state-surrogate administration letters could not displace that title.
This particular horse and nineteenth-century legal setting must not be confused with the later Seneca Nation surrogate institution in Jimeson v. Lehley (#1221).
Separations: 1848 customary allocation ≠ 1906 Nation surrogate; Erie County state-surrogate letters ≠ Nation council appeal path; one horse estate ≠ general probate rule. Source: 1848-dole-irish-seneca-customary-horse-estate.
