Finding #1232 recovers Joel Silverheels v. Hattie Maybee et al., 82 Misc. 48–57 (Cattaraugus Equity Term, August 1913). Joel Silverheels won an Allegany Reservation land-possession judgment in the Seneca Peacemakers’ Court on March 18, 1895. The Nation council affirmed on April 6, 1907, yet a marshal’s writ did not dislodge the successor occupant.
Justice Laughlin ordered enforcement in 1913, finding the lost original Peacemakers’ judgment sufficiently proved by oral evidence, later council remittitur, and surviving copied record. This is a court judgment directing delivery — not evidence the parcel was actually delivered.
Separations: Allegany land in Cattaraugus County ≠ Cattaraugus Reservation; Emeline Jimeson here ≠ Emeline of #1229 Cattaraugus dower (shared name alone ≠ identity); 1888 council $350 ≠ 1882 release $300 — different recitals, dates, claims; Dec 31 1907 writ failure ≠ 1913 delivery proved.
