Finding #1233 recovers George Terrance v. Michael J. Crowley, 62 Misc. 138–145 (Franklin Trial Term, January 1909). A proposed exchange of an allotted St. Regis Reservation farm (Thomas Gray farm, Bombay) for Crowley’s store stock unraveled when purported purchaser Alex White retrieved and burned his $3,300 notes.
Justice Van Kirk refused to enforce the inseparable goods contract because an individual could not convey fee title in that tribal land (occupancy/use under Indian Law §102 allotment, not alienable fee). Yet he ordered return of the deed, net-proceeds accounting, and possession restored — or $3,300 if restoration failed. That figure is a conditional remedy, not evidence the occupant received $3,300 cash.
