Sol #1248 — 1850 Senate Report No. 192 itemizes six Seneca claims ($28,505.50)
Sol Archive #1248 locates the committee assessment of the still-uninspected 1848 investigation. On September 9, 1850, Senator Wales reported for the Senate Committee on Indian Affairs (In Senate of the United States, 31st Cong., 1st sess., Senate Committee Report No. 192, printed pp. 1–5; Serial Set 565). The committee endorsed the results of an investigator appointed under the June 27, 1846 act, set out six components totaling $28,505.50 before interest, and recommended an item in the Indian appropriation bill for principal and interest. This is a committee recommendation — not an enacted appropriation or payment.
The report states the investigator’s report and evidence constituted Senate Document No. 31, 30th Cong., 1st sess. (#1247 identity). It dates the Secretary’s submission to Congress to January 8, 1848; the Senate Journal records the report’s January 19 floor presentation (#1246). Those dates must not be silently collapsed. The unnamed agent is said to have resigned in 1840; this report does not name James Stryker.
Six printed components (p. 4 schedule):
- $7,143 — principal of the Phelps and Gorham annuity fund (1788 land transaction), said to have disappeared under the federal agent’s control in 1837; purported replacement mortgage described as worthless due to a prior 1835 encumbrance.
- $7,500 — unpaid $500 yearly annuities from that fund; schedule says “from 1837 to 1850 inclusive, fifteen years.” Printed endpoints inclusive span fourteen calendar years; $7,500 ÷ $500 = 15. Narrative also says deprived “since 1836” while p. 2 says first withheld 1837 — report does not reconcile; neither an extra year nor a corrected $7,000 is established here.
- $7,749 — three annual $2,583 income payments in 1837–1839 on U.S. stock placed at Ontario Bank in Canandaigua in trust. Committee says the bank paid income to the agent and he did not pass it on; stock was still there. Not a claim that bank-stock principal vanished; not automatically the separate $75,000 1842-treaty fund in the 1846 statute (#1242).
- $1,000 — New York State treaty annuities, $500 in each of 1837 and 1838, which the committee says the agent received without paying the Senecas.
- $3,482.50 — contested 1838 federal annuity distribution (Buffalo bank deposit, forced taking, search-warrant recovery, re-deposit, transfer to agent). Of $3,600 entrusted, only $117.50 said to have reached heads of families. Underlying bank/court records not presented.
- $1,631 — due Mrs. Polly Jimeson personally, not the Nation: after entrusting money for safekeeping she recovered $180; stated balance lost. Report expressly calls this “the claim of an individual Indian rather than of the tribe.” No identity connection to later Jimeson/Jemison persons is inferred.
Six sums add to $28,505.50. Proposed interest was additional and not quantified. Committee argued federal appointment created a moral obligation; notes an earlier Senate appropriation item had been rejected by the House, prompting the 1846 inquiry. On p. 5 it says the Senecas intended any allowed sum for manual-labor and other schools, then recommends inserting principal+interest in the Indian appropriation bill. Intention ≠ schools founded; report ≠ bill ≠ statute ≠ warrant ≠ receipt.
- Committee recommendation ≠ enacted appropriation ≠ disbursement.
- $28,505.50 six-claim total ≠ $75,000 ≠ ≤$500 ≠ ~40,000 Hall proposal ≠ $48,216/$43,050/$5,166 deed gap.
- Ontario Bank income claim (#3) ≠ bank-stock principal vanished ≠ #1242 $75k 1842-treaty credit.
- Polly Jimeson personal $1,631 ≠ tribal aggregate; Jimeson ≠ Jemison without proof.
- “1837–1850 inclusive, fifteen years” ≠ 14-year endpoint span — arithmetic tension flagged, not corrected.
- Jan 8 submission date ≠ Jan 19 floor presentation — not collapsed.
- Unnamed agent resigned 1840 ≠ proven = James Stryker (#1244 notice only).
- #1248 1850 S.Rept.192 ≠ #1247 Doc.31 identity ≠ #1246 presentation ≠ #1245 Hall amendment ≠ #1244 Stryker notice; 1848 investigation body still unseen.
