Sol #1252 — 1857 Seneca relief chapter 45 (enactment index ≠ execution)
Finding #1252 narrows the fate of the 1857 Seneca tax-sale rescue. Finding #1251 correctly showed Senate Bill No. 85 only as reported / read twice / committed to the whole. A dedicated 1897 Index to the Session Laws of the State of New York (Silvernail) now supplies the enactment clue: under “Indians—Seneca,” it lists “to relieve the—c. 45, 1857” and notes that § 4 was revised into the 1892 Indian Law, ch. 679, § 6.
So a Seneca relief act appears in the enacted 1857 session laws as chapter 45. That is a bibliographic legislative citation — not the act’s full text, not proof that Bill No. 85 passed verbatim, and not proof that the State redeemed land, paid private grantees (purchase money + 7% interest + deed costs), issued redemption certificates, or changed possession.
Second citation problem held: the Jan 22 1857 Judiciary Committee report attributes 1845–48 highway taxes to a statute “passed May 4th, 1849, (chap. 254,)” then refers to an 1840 act. The same 1897 index catalogs 1849 ch. 254 under Militia—Organization of the first division (amendment to 1847 ch. 205 / 440), not as a Seneca reservation-tax measure. Correct tax-statute identity remains open.
Separations locked (add to #1251 stack):
- #1252 enactment-index citation ≠ original chapter text inspected ≠ Bill 85 verbatim passage
- 1857 ch. 45 “to relieve” Seneca ≠ proof of redemption / payment / certificates / possession change
- §4 → 1892 Indian Law §6 (index note) ≠ full five-section bill authenticated as ch. 45
- 1897 index bibliographic aid ≠ substitute for session-law volume or journals
- 1849 ch. 254 militia catalog ≠ committee’s tax-statute claim; 1845–48 basis still unresolved
- #1252 ≠ #1251 ≠ #1250 ≠ #1249 ≠ #1248; Allegany ≠ Cattaraugus; 31,800 ≠ 13,300; tax-sale ≠ title-valid
