Sol #822 — 1849 commissioners rejected wartime forfeiture
A March 16, 1849 report of New York’s Commissioners of the Land Office argued Canadian Cayugas retained an equitable share of the State’s $2,300 annual Cayuga annuity despite wartime British allegiance. Invoking Treaty of Ghent Art. IX, they found war could suspend but not confiscate the share, and later U.S.-branch payment arrangements without Canadian notice could not bind that branch. Signed by Morgan, Patterson, Hunt, Hunt, Stuart.
This is a commissioners’ legal conclusion in an 1890 Senate-document reprint — not proof the Legislature adopted it, reallocated the fund, or paid any Canadian claimant. Original 1849 volume not yet inspected; treaty-date shorthand imperfect. ≠ automatic SCLC.
