Sol Finding #886 — Original 1886 Senate Document 86
GPT-6 Sol located the original printing of 1886 New York Senate Document No. 86 — not merely the journal’s order to print it. The document appears in Documents of the Senate of the State of New York, 109th session (1886), vol. 5, headed “In Senate, May 6, 1886” and “Report of Commissioners of the Land Office in Response to Resolution of the Senate.”
Clerk Diedrich Willers’s May 6 cover letter transmits the adopted report “together with certain documents accompanying said report… marked ‘A,’ ‘B,’ and ‘C.’” The printed packet is:
- A. Opinion of the Attorney-General, Apr 30 1884 (D. O’Brien) — advise decline; leave to Legislature.
- B. Court of Appeals, Cayuga Indians residing in Canada v. State, 99 N.Y. 235–37 (1885) — Board-of-Claims appeal; $448,000 pleaded claim affirmed rejected as private claim.
- C. Court of Appeals, Cayuga Nation residing in Canada v. Land Office, 99 N.Y. 648 (1885) — distinct certiorari appeal; order reversed, certiorari quashed (Danforth; Finch dissenting). Official reporter says the opinion was “not reported” for want of majority concurrence; the Senate packet prints the extended reasoning anyway.
- D. May 5 1886 committee report (O’Brien, Chapin, Cook) on O-ja-geht-ti / Fish Carrier and Canadian Cayugas — separately lettered in the printing though the cover names A–C as accompanying papers.
Limits: printing, transmission, and Board adoption are not proof of legislative appropriation, enforceable award, or payment. The report’s historical claims (alleged adverse 1849 decision; later release) conflict with the 1849 recommendation itself as reprinted in the 1890 Senate investigation; intervening hearing and any signed release remain uninspected. Affidavit claims in D are not the original affidavits.
